It was the Chief Pilots fault technically
1. ATC was working double that night, he could have been tired and over worked and he might have not seen the planes altitude on the Radar
2. The Chief Pilot was listening to the ATC when he knows TCAS was telling him to Climb, he should have known better if he is a Chief Pilot
3.The ATC did not hear the DHL pilots say that TCAS was telling to descend because he went to the other Radar to check on the other flight.

In the US the regulations are very clear on this. The pilot has ultimate authority and responsibility for the safety of the flight. Not ATC-- the pilot. All US pilots are instructed to follow TCAS and disregard the controller under such circumstances. In Russian culture there is a lot of reluctance to challenge authority and so they emphasize obediance to the controller. That was an error.
